Terms of Use
These Terms govern your use of gastovia.com (the "Website") and any pre-launch interactions with Gastovia, including chat, email, intro calls, and onboarding discussions. Once you become a paying client, a separate Service Agreement governs the operation of your shop and overrides these Terms where they conflict.
1. Who we are
Gastovia is operated by its founders, providing a full-service online shop solution for independent restaurants. Contact: hello@gastovia.com.
2. What this Website is
This Website describes our service, lets restaurants get in touch with us, and runs ongoing campaigns (e.g. Father's Day). It is informational. Submitting a contact form, starting a chat, or booking a call does not create a binding service agreement on its own.
3. Eligibility
You may use the Website if you are at least 18 years old. To engage Gastovia as a client, you must represent a legal restaurant or hospitality business and have authority to enter into agreements on its behalf.
4. Permitted use
You agree to use the Website only for lawful purposes. In particular, you agree not to:
- Reverse engineer, scrape at scale, or replicate the Website
- Use the chat or contact form to send spam, malware, or unlawful content
- Misrepresent who you are or which restaurant you represent
5. Pricing & promotional offers
Promotional offers shown on the Website (for example, "free setup for the first 5 restaurants in Tampa") are valid only as described, in the regions described, and only until the limit is reached or the campaign ends. Final pricing is confirmed in writing during onboarding before any commitment.
6. Intellectual property
The Website, including the Gastovia name, logo, design, and copy, is owned by Gastovia. You may share links to the Website freely. You may not copy material design or copy elements for a competing service.
If you become a client: your brand, content, and customer data remain yours. We grant ourselves only the licenses needed to actually run your shop on your behalf. Details are in the Service Agreement.
7. Third-party services
The Website uses third-party services (e.g. HubSpot for chat, Stripe for client payments). Those services have their own terms and privacy practices. We are not responsible for changes those providers make to their products.
8. Disclaimers
The Website is provided "as is". We do not promise it will always be available, error-free, or fit for any particular purpose. Information on the Website (including marketing claims) is illustrative; the binding terms of any service we provide are set out in the Service Agreement signed before launch.
Nothing on the Website is legal, tax, or financial advice.
9. Limitation of liability
To the maximum extent permitted by law, Gastovia is not liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Website. Our total liability arising from your use of the Website is limited to USD 100. This limit does not apply to fraud, willful misconduct, or anything that cannot legally be limited.
10. Termination
We may suspend or terminate access to the Website at any time, for any reason — for example to protect the site from abuse. Sections that by their nature should survive (IP, disclaimers, liability, governing law) survive termination.
11. Governing law & disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida, unless local consumer-protection law gives you a non-waivable right to a different forum.
12. Changes
We may update these Terms from time to time. The "Last updated" date above shows the current version. Continued use of the Website after a change means you accept the updated Terms.
